EU conducts total protection of personal data on social networks

Such giants as WhatsApp and Instagram prepare for the innovations in Europe, and Facebook does not react on the regulation being introduced.
By the end of May, 2018, the General Data Protection Regulation will enter into force within the European Union, which is extraterritorial, Gazeta.ru reports.

The new rules relate not only to European companies, but also any organizations that have an access to personal data of the EU citizen. Regulation of storage, usage and collection of user information or GDPR (general Data Protection Regulation) is obligatory and relate not only to social networks and different services, but also to any organizations and services that receive electronic information

Firstly, the organization that receives personal data should inform the user that his data will be stored on the company’s servers.

Secondly, all data collected should have appropriate protection.

Thirdly, companies are not allowed to hand over any data to the third party, because of the recent scandal regarding Facebook and collection of personal data for other organizations.

Non-compliance with the new legislation will lead to fines with the highest fine of 20 million euros, which will be a considerable loss for such giants as Microsoft and Google. But, as of today the way and the amount of fines are uncertain for the companies that are not legally registered within the EU. At the same time, large social networks and instant messengers prepare for the new regulation.

WhatsApp announced its upgrading of the user agreement regarding GDPR. The most considerable change was the minimal age to use the app, which is not 13, but 16, and in other regions, the minimal age remained at the previous level.

Instagram also changed some conditions for use. Among them the function that allows to download all user date, including all photos and videos from posts, as a separate file and archive, which will be sent to the e-mail.

The largest social network of Facebook that owns WhatsApp and Instagram should be separately considered. Unlike the leadership of subsidiary enterprises, Facebook does not make large steps towards preparing for the new rules. A number of European human rights activists and experts in the sphere of Internet security express fear that Facebook in Europe can have bad consequences. At least, the social network has a risk of receive a fine because of non-compliance with GDPR. Fear is also added regarding the recent scandal with Cambridge Analytica. Attorneys of Facebook say that they weighted all risks regarding the new legislation and do not see big problems for the social network’s functioning within the European space.

The GDPR norms cover all legal entities working with personal data and within the European Union, not considering their place of registration. Therefore, largest Russian companies should follow the new rules.

As for VKontakte, we fully follow the legislation, and GDPR is not an exception. A new policy of confidentiality will be created for European users, where the types of data processed when using the product, the way of its processing and the reason of its processing will be told simply and comprehensively. Our preparation includes the adjustment of the existing procedures and the company’s activity, including the activity of the support service, with the aim to fully correspond to the new European regulation," Mariya Klimenko, head of the legal department of VKontakte, told Gazeta.Ru.
