Astana. February 21. Kazakhstan Today - Today at the plenary session the Senate deputies approved in the first reading the bill on amendments and additions to the acts concerning application of preventive punishment in the form of arrest, the agency reports.
As it was informed earlier, the objective of the bill is bringing current legislation in conformity with the article 16 of the Constitution.
The amendments are introduced to the Criminal-Judicial Code and the law On Prosecutor's Office.
According to the procedure stipulated by the bill, in case of choosing arrest as a preventive punishment, the body of inquiry, the inspector presents a petition for court for authorization of arrest, which along with the materials of the case is given to the public prosecutor.
The public prosecutor by his decision supports or does not support the petition and pronounces a verdict. Thus, refusal of the public prosecutor in consent of choosing arrest as a preventive punishment can be appealed against by the body of inquiry, the inspector in the higher public prosecutor or in court.
The bill has been forwarded to the profile committee of the Senate for preparation for the second reading.
