Constitutional Council cancelled decree on arbitration courts in Kazakhstan

The Constitutional Council declared that the decree concerning the activity of the arbitration courts in Kazakhstan, as well as lifting ban on merge of the state and public institutions have been cancelled, the agency reports.

Astana. February 8. Kazakhstan Today - The Constitutional Council declared that the decree concerning the activity of the arbitration courts in Kazakhstan, as well as lifting ban on merge of the state and public institutions have been cancelled, the agency reports.

"The decree of February 15 2002 № 1 and the additional decree of April 12, 2002 № 1/2 have been reconsidered and cancelled," the chairman of the Constitutional Council Igor Rogov informed.

The necessity has become imminent in connection with the introduced amendments to the Constitution of the country in May, 2007. "Constitutional Council continues to work on bringing the accepted decrees in accord with the new edition of the Constitution," he noted.

According to the decree cancelled on Thursday, the appeal to the arbitration court was not judicial protection, consideration of disputes in the arbitration courts did not fall under the concept of justice, which is carried out only by the state court.
