Shymkent court rejected judge's diversion

Shymkent. January 23. Kazakhstan Today - The court of Shymkent on the case of HIV-infection of the children in the South Kazakhstan oblast rejected the lawyers for the defense diversion of the judge Ziyadinhan Pirniyaz and the public prosecutor, the source informed the agency. Attorney for defendants petition for the repeated investigation, the agency reports.

Last night after the end of the process on the case of mass HIV infection of the children in the South Kazakhstan oblast the lawyers informed the journalists that the diversion had been rejected: the judge and the state prosecutor will remain unchanged.

"According to the law, diversion can be claimed to the public prosecutor if there are reasons to consider that he can be interrogated during the main proceeding as a witness. Some of the defendants assert that the public prosecutor directly took part in the interrogation of the defendants," the lawyer Musatay Bektasov explained.

As it was informed earlier, the court procedure on the case of intra hospital HIV infection started its work on January 19 in Shymkent. 21 accused on the case of HIV infection of children have been arrested, 18 of whom are medical workers. Some of them alongside with negligence are incriminated with taking bribes by blackmail, swindle, plunder of public funds in large sizes. The former chief of the department of public health services Nursulu Tasmagambetova has been accused of criminal negligence.
