President of Russia signed law on ratification of Kazakhstan-Russian agreement

Almaty. July 24. Kazakhstan Today - The President of Russia, Dmitry Medvedev, signed the Federal Law on Ratification of the Agreement between the government of the Russian Federation and the government of the Republic Kazakhstan on cooperation in creation of economic society on the basis of Orenburg Gas Processing Plant, the agency reports referring to the press service of the President of the Russian Federation.

According to the press service, the Federal Law is directed at ratification of the Agreement between the government of the Russian Federation and the government of the Republic of Kazakhstan on cooperation in creation of economic society on the basis of Orenburg Gas Processing Plant, which was signed in Uralsk on October 3, 2006 and was temporarily applied since then.

The agreement is directed at strengthening of long-term Russian-Kazakhstan economic cooperation in gas industry and creation of new processing capacities on the basis of Orenburg Gas Processing Plant for effective processing of hydrocarbonic raw material extracted by Gazprom and other organizations in the Russian Federation and in Karachaganak deposit of Kazakhstan.

The Agreement ratified by the Federal Law is directed at development of the Agreement between the government of the Russian Federation and the government of the Republic of Kazakhstan on cooperation in gas industry of November 28, 2001.

The Federal Law was accepted by the State Duma on July 4, 2008 and approved by Federation Council on July 11, 2008.

As it was informed earlier, the President of Kazakhstan, Nursultan Nazarbayev, on February 5, 2008 signed the law ratifying the agreement between the government of Kazakhstan and the government of the Russian Federation on cooperation in creation of economic society on the basis of Orenburg Gas Processing Plant.

In accordance with article 1 of the agreement, the government of Kazakhstan and Russia assist JSC Company KazMunayGaz and Open Society Gazprom in creation on a parity basis economic society on the basis of Orenburg Gas Processing Plant, which is a part of a unified system of gas supply of the Russian Federation.

In accordance with article 2 of the agreement, the joint venture is created under condition of conclusion of long-term (not less than 15 years) commercial contracts providing purchase and processing on capacities of joint venture of crude gas, extracted in Karachaganak deposit in volume of not less than 15 billion cubic meters a year on conditions specified in the contracts and realization of the processed gas in Kazakhstan market, and its export through the uniform export channel of Open Society Gazprom.

According to article 6, the authorized organizations define the order and conditions of delivery of processed gas from Karachaganak deposit to the market of Kazakhstan on a priority basis, including counter deliveries on mutually beneficial conditions according to the legislations of the states-parties. Counter deliveries are carried out in equal volumes and at the identical price. Thus, the price of gas in counter deliveries, including under contracts of sale and purchase, is not subject to change for the purposes of taxation.
